REFUND POLICY - CRITICAL INFORMATION
Gold Coast Learning Centre (GCLC), has a fair and equitable refund policy and procedure that is compliant with ASQA and the ESOS Act requirements. This policy is provided to students prior to any contract being signed OR prior to any payment of the course (whichever happens first). GCLC has implemented policies and procedures to ensure students are protected by the provisions of the ESOS Act 2000 and by ESOS Regulations 2001. The refund policy and procedure is made available to students through our website, Pre-Information booklet and Student booklet.
All refunds are subject to the following clauses:
1. All refund applications require a completed Refund Request Form and a Cancellation of Course Form, along with relevant supporting evidence from any student requesting a refund. The completed form must be submitted to the Manager by email manager@goldcoaststudy.com or posted to GCLC’s postal address at P.O Box 567 Surfers Paradise QLD 4217 Australia. Any request for a refund received is then assessed by management for eligibility.

2. Bank charges and any subsequent processing fees incurred for processing overseas electronic transfer or telegraphic transfer or bank draft will also be deducted from any refunds due.

3. Students may not defer or change the start date of their first course, except in exceptional circumstances, as reviewed on a case by case basis by Management. Any deferments must be supported by evidence as to why the deferment is required. Students who wish to defer their agreed course start date must give at least 2 weeks written notice prior to the agreed course start date. If a Student lodges an application for deferral and the application lodgement date is less than 2 weeks prior to the agreed start date, a fee of $200 per week will be payable upon lodgement. The student accepts that if a deferral is approved, in any case such as claims relating to cancellation, the Student agrees that they will be deemed to have started their enrolment on the original agreed start date and not the agreed course start that was deferred. A Student who submits an application to defer their start date and then starts on the agreed course start date that was deferred, and then withdraws from the course due to visa refusal, will only be eligible to receive the tuition fees for the period of the default as a refund. All Non-tuition fees as outlined in Clause 12 of this Refund Policy are non- refundable.

4. Any course fees paid are not transferable to other institutions or other students once you commence your enrolment at GCLC.

5. If you start your course on the agreed course start date or an approved agreed deferred date of course commencement as per the Confirmation of Enrolment documents and Enrolment Form, then withdraw voluntarily or have to cancel your course for personal or other reasons, there will be no refund be granted unless the student has a legitimate complaint against GCLC that can be substantiated under the Consumer Protection Laws of the Commonwealth of Australia or the State of Queensland. GCLC may at its discretion, offer to provide you with a course at another time or placement into another course of equal or less value.

6. If a student begins a course without the required visa being granted, and then receives a notice of visa refusal, the student will only be eligible for a refund of tuition fees but only tuition fees for the period of the default, will be refunded. All Non-tuition fees as outlined in Clause 12 of this Refund Policy are non- refundable. Any refund of tuition fees will be calculated and assessed on the period of the default and based on the original agreed enrolled start date (an agreed course start date, not a deferred agreed course start date) as per the original Confirmation of Enrolment documents and Enrolment Form, and the date of lodgement of the Refund Application Form and Cancellation of Course Request form.

7. After commencement, there is no refund if you withdraw voluntarily, if you are dismissed or expelled due to being in breach of GCLC Code of Conduct or if you are in breach of Australian State or Federal Government Laws and Regulations, will receive no refund of any fees. Students with outstanding payments remaining on payment plans will be required to pay the remainder of fees for the course they are currently studying plus a $250 cancellation fee per subsequent enrolled course. (All payment plans are managed via Ezidebit Direct Debit. Your completed Direct Debit Request Application Form to facilitate your required Payment Plan forms a binding contract).

8. Any student who enrols in a package consisting of multiple course enrolments for the purpose of achieving a discount of fees and then consequently cancels the package after commencement, will:
A: Forfeit the package discount price. Enrolments will be treated as individual course enrolments from the start of the first course.
B: Be required to pay current full retail price of the course(s) the student has previously completed and/or is currently studying.
C: Pay the remainder of the course fees due for the current enrolled course and, if applicable, adjust any payment plan currently in place accordingly to meet the new course fees payable.
D: GCLC may at its discretion, offer to provide you with a course at another time or placement into another course of equal or less value.

9. Following compliance with Clause 1, if GCLC receives written notice of cancellation of enrolment 28 days or more prior to the course commencement, a refund of 50% of tuition fees will be made. No refund of Non-Tuition Fees is payable. (excluding cancellation due to visa refusal)

10. Following compliance with Clause 1, if GCLC receives written notice of cancellation of enrolment less than 28 days prior to the course commencement, a refund of 30% of tuition fees will be made. No refund of Non-Tuition Fees is payable. (excluding cancellation due to visa refusal)

11. Following compliance with Clause 1, if GCLC receives written notice of cancellation of enrolment on or before the course commencement, due to visa refusal, a refund of 100% of the course fees or deposit received will be made minus the lesser of the following amounts:
(a) 5% of the amount of course fees received by the provider in respect of the student before the default day;
(b) $500

12. Please consider this clause very carefully, as the following are considered to be non-tuition chargeable fees.
Non-Tuition chargeable fees specifically include the following;
• A $250 cancellation fee per course and per cancelation of each subsequent enrolled course will apply.
• Enrolment fees ($200)
• Material fees (Specific to your enrolled course(s) as listed on the Letter of Offer and as outlined in detail on your Tax Invoice)
• E-Learning allocation fees ($40 per individual course unit)
• Homestay Placement fees
• Airport Transfer fees
• Telegraphic transfer fees and subsequent fees relative to processing the payment will be applied to any refund due, after the refund is calculated.
• Refunds payable to an international bank account or via a non-bank entity such as Western Union or similar will attract fees relative to processing the payment and will be applied to any refund due, after the refund is calculated.

13. This agreement, and the availability of GCLC’s complaints and appeals process, does not remove the right to take action under Australia’s consumer protection laws.
